AN ACT TO AUTHORIZE THE MISSISSIPPI SCHOOL FOR THE BLIND, BY AND THROUGH THE DEPARTMENT OF FINANCE AND ADMINISTRATION, TO GRANT A TEMPORARY CONSTRUCTION EASEMENT AND TO CONVEY CERTAIN STATE-OWNED REAL PROPERTY TO THE CITY OF JACKSON, MISSISSIPPI, FOR THE PLANNED IMPROVEMENTS TO HIGH STREET; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) The Department of Finance and Administration, on behalf of the State of Mississippi, may convey all rights, title and interest in certain property located in Hinds County, Mississippi, to the City of Jackson, Mississippi, the property being more particularly described as follows:
A triangular-shaped parcel of land in that certain tract of land described in the documents filed for record in the office of the Chancery Clerk of the First Judicial District of Hinds County, Mississippi, in Deed Book 1764 Page 281 and in Deed Book 2370 Page 206. Said tract of land being a portion of 2 Acre Lot 10, North Jackson, according to the official map of the City of Jackson, made by Henry C. Daniel in 1875. Said triangular-shaped parcel of land being more particularly described as follows: Commencing at the southeast corner of said Lot 10, go North 08 degrees 46' 19" East a distance of 3.048 meters (10.00 feet); thence go North 81 degrees 21' 04" West for a distance of 3.048 meters (10.00 feet) to the intersection of the north and west line of a permanent easement granted to the City of Jackson as recorded in Deed Book 1820 beginning at Page 317, said point being the Point of Beginning of the parcel of land described as follows, to wit: From said point of beginning, thence go North 81 degrees 21' 04" West for a distance of 6.390 meters (20.96 feet) along the north line of said permanent easement adjacent to High Street; thence go North 44 degrees 38' 49" East for a distance of 10.904 meters (35.77 feet) to the west line of said permanent easement adjacent to Jefferson Street; thence go South 08 degrees 46' 19" West for a distance of 8.822 meters (28.94 feet) along west line of said permanent easement adjacent to Jefferson Street to the point of beginning.
(2) The conveyance authorized by this section may be made on such terms and conditions agreed upon by the Department of Finance and Administration and the governing authorities of the City of Jackson, Mississippi, to be in the best interest of both parties as well as the citizens of the community.
(3) Any funds received by the State of Mississippi for the conveyance of the real property described in subsection (1) of this section shall be deposited into the Mississippi Schools for the Blind and Deaf Repair and Renovation Fund No. 3912.
(4) The State of Mississippi shall retain all mineral rights to the real property sold pursuant to this section, with the rights of ingress and egress to remove such minerals.
SECTION 2. (1) The Department of Finance and Administration, on behalf of the State of Mississippi, may grant a temporary easement to the City of Jackson, Mississippi, over and across certain state-owned property, the property being more particularly described as follows:
Two strips of land, each 1.52 meters (5.00 feet) in width and across that certain tract of land described in the documents filed for record in the office of the Chancery Clerk of the First Judicial District of Hinds County, Mississippi, in Deed Book 1764 Page 281 and in Deed Book 2370 Page 206. Said tract of land being a portion of 2 Acre Lot 10, North Jackson, according to the official map of the City of Jackson, made by Henry C. Daniel in 1875.
The first of said 1.52 meter (5.0 feet) wide strips of land being adjacent to, contiguous with, and northerly of the present north right-of-way line of High Street and more particularly the north line of that certain permanent easement granted to the City of Jackson as recorded in the office of said Chancery Clerk in Deed Book 1820 at Page 317. The north line of this 1.52 meter (5.0 feet) wide strip of land commences at a point on the west boundary of said tract of land at a point which is a distance of 1.52 meters (5.00 feet) north of said permanent easement and runs South 81 degrees 21' 04" East for a distance of 39.986 meters (131.19 feet) to its point of terminus.
The second of said 1.52 meter (5.0 feet) wide strips of land being adjacent to, contiguous with, and westerly of the present west right-of-way line of Jefferson Street and more particularly the west line of that certain permanent easement granted to the City of Jackson as recorded in the office of said Chancery Clerk in Deed Book 1820 at Page 317. The west line of this 1.52 meter (5.0 feet) wide strip of land commences at a point on the north boundary of said tract of land at a point which is a distance of 1.52 meters (5.00 feet) west of said permanent easement and runs South 08 degrees 46' 19" West for a distance of 73.116 meters (239.88 feet) to its point of terminus.
(2) The temporary easement authorized by this section may be made on such terms and conditions agreed upon by the Department of Finance and Administration and the governing authorities of the City of Jackson, Mississippi, to be in the best interest of both parties as well as the citizens of the community.
(3) Proceeds of the property interest attributable to the State of Mississippi shall be deposited into the Mississippi Schools for the Blind and Deaf Repair and Renovation Fund No. 3912.
SECTION 3. This act shall be deemed to be full and complete authority for the exercise of the powers herein granted.
SECTION 4. This act shall take effect and be in force from and after its passage.
